Right of daughter in father's property after his death


Right of daughter in father   My father got expired recently, We were 5 daughters and 5 brothers but one of my elder brother got expired one year back before demise of my father, my father didn't left any will, just wanted to know whether my sister in law or children of my expired brother can claim their share in my father's property legally?


   As a daughter you have an equal share in the property of your father if he has not left any will. The legal heirs of your father's pre-deceased son will succeed to his share in his father's property. You can cull out your share by filing a suit.

   As your father expired intestate (without Will)the property is to be divided into 11 shares if your mother is alive otherwise in 10 shares.Your bhabhi(wife of deceased brother) and her children shall get their share from 1/11 or 1/10 share.You can file suit for partition for claiming your share.For further information /assistance you may contact me through Path legal.
