My wife after d 8 years of marriage having the five years old son filed a false rape case of 2004 against me and kidnapping of 2010 against my mother sister and me and rape against my father of 2016 was filed by my wife in the year 2018. I married her in 2010 at Arya samaj Mandir by changing my religion from Muslim to Hindu and later in 2011 both of us change the religion from Hindu to Muslim and married according to Muslim law nikah and after that girl left for parental home and we started our marital life she is saying that both the marriage was done forcefully by me and Arya samaj Mandir no fera and any tradition was follwed only she put signature which is absolutely false
Is she intitle for maintenance
If we want to go for the divorce which marriage law is applicable Hindu marriage law Muslim marriage law
sir for the divorce go for the ex parte and for the money part you need to give for the kid . for the RAPE case file for the medical test for every person with the wife the only evidence then . for the kidnapping case file the perjury and defamation on her . but then too you need to quash all the case in the honorable high court as I suppose all of them are for harassment only .
Buddh marriages are valid the payment of maintenance as your wife that married by the Muslim as well as by the angular event that you have not been registered in any of the applicable law in case you have been registered previously there was no matter of deciding the act which will be applicable apart from the criminal case which is under investigation by the police seek and of course for the maintenance as legally wedded wife
you have changed your religion and married so the Muslim law applies for you both to take divorce.
1.see if your version is correct and she is making a mistake then u have chances to prove and unable to pay the maintenance
2.marriage is valid even though it is a force.
3.if she filed a case on your parents then go to the high court for quashing petition stating that your parent's health condition is not good and to remove from that case and state that they don't come under this case
4.it may relief you atleast some and you can proceed to further to any lawyer by consulting
