petition u/s 205,70(2) cr.p.c   to recall NBW can i file the petition petition u/s 205,70(2) cr.p.c in the absence of accused


   No 205 is filed when the summons is issued and you cannot appear, and if you file 70(2) as now as the warrant is issued the court will insist to keep the accused present so it is difficult without the presence of accused.

   If the NBW is issued ,it can be recalled by presenting the accused in the court and apply for cancellation of NBW,then if NBW is cancelled court will recall NBW which is sent to the police station .say'like'if not satisfied contact me on phone
