Classification of law
Law:: These are the rules and regulations which control the society and which helps in the proper governance of the county. The object of the law is to establish socio-economic justice
All law is classified as either criminal or civil. Both criminal and civil law is made up of substantive laws and procedural law
Civil law: The civil law talks about the rights and duties of individual to each other. Penalties under civil law are monetary damages, injunctions, and specific performance. The parties under civil law is the plaintiff and defendant.
Criminal law: The purpose of criminal law is to protect society. The penalties under criminal law are fines, restitution, death. The parties under criminal law is prosecutor and defendant.
Substantive law: It tells you what you can and cannot do.
Procedural law: It tells the government what process to use and how to address a situation where someone has not followed the substantive law.
Private law consists of the rule that involves the relationship of private individuals to each other. Most civil law is private law, including tort law, contract law, and most property law.
Public law consists of rules that involve the relationship of government to society as a whole. Constitutional law, administrative law, and criminal law are examples of public law.
NATIONAL LAW: It is the combination of private and public law. It is enacted by a state.
CONSTITUTIONAl LAW: It is the fundamental law of the land. It is the supreme law of the land.
ORDINARY LAW: It is enacted by the legislature and affects the day to day administration of the state. Violation of these laws leads to punishment.
ADMINISTRATIVE LAW: It regulates the relationship between civil servants
COMMON LAW: It is based on traditions. It is an integral part of state laws.
INTERNATIONAL LAW: It is the body of rules which is binding on a sovereign state and it also maintains a relationship between states.
