legal question Hi,I booked 1 bhk flat in 2018 in Thergaon Pune,Oak view residency project,as per agreement possession date was dec2019 also same date was in Maharera, builder failed to give possession on time I paid whole amount 40 lakh to builder,in feb builder extend possession date to Dec 2020 in Maharera without intimating ,in March due to Covid government extend further six months for possession, as per agreement I can ask interest for delay possession,or can I cancel booking as I unable to match emi and house rent due to deduction in salary.

After the complaint they enter into a memorandum of Understanding between with the property owners and refund their amount on monthly basis or either hand over the possession.

You need to first send the legal notice to builder for any one of the below mention option. In case of non response from the builder the you have to file online complaint with the RERA tribunal.

You can complaint to Real Estate (Regulation and Development) Act, 2016 authority and get is registration cancelled on the ground of unfair trade practice and fraudulent trade practice if the project is registered under Real Estate (Regulation and Development) Act, 2016.
2. If the project is not registered under Real Estate (Regulation and Development) Act, 2016 u can file complaint in Consumer Forum and get your money back with interest.
3. You can make bank party in all these to establish your bon fide.
4. Police complaint for cheating and dishonest misappropriation of property.
5. Under Real Estate (Regulation and Development) Act, 2016 he is required to deposit a part of advance intimate them not to release it to the builder.
