legal answer from lawyer E00321627There grounds under Hindu Marriage Act, 1955 for seeking divorce, treating husband/wife with cruelty is one of the prominent grounds, and cruelty can be physical as well as mental. You can file divorce on that ground. Domestic violence is manifestation of cruelty. You can also make an application to the Magistrate under Domestic Violence Act and obtain following reliefs—
a. You can obtain right to reside in your husband’s house with police protection.
b. You can obtain monetary reliefs towards maintenance of you and your children.
c. You can also get compensation apart from above.
d. Your children have share in his all property.
e. You can seek protection from them, a police will provide you protection.
You can also seek maintenance by filing an application under Section 125 of Code of Criminal Procedure, 1973. Filing case in fast track court does not meant that it will move fast. It depends on client and his lawyer, if the client hotly pursues the case the case will be disposed off fast.
