DIRECT RECRUITMENT TO THE POST OF DISTRICT JUDGE LAST DATE FOR RECEIPT OF ONLINE APPLICATIONS: 21ST OCTOBER, 2020

It is hereby notified that under Article 233 of the Constitution of India read with the provisions of the Karnataka Judicial Service (Recruitment) Rules, 2004 and Amendment Rules 2011, 2015 and 2016, High Court of Karnataka invites online applications from eligible candidates for filling up of 30 vacant posts of District Judges (23 backlog vacancies and 7 fresh vacancies) by direct recruitment.

QUALIFICATION:

  1.   Must be holder of a degree in Law granted by a University established by Law in India;
  2.  Must be practicing as an Advocate in the High Court or in a Subordinate Court on the last date fixed for receipt of applications and must have so practiced for a period not less than SEVEN years as on such date.
  3. Note: Public Prosecutor/Assistant Public Prosecutor/Government Counsel in full time employment of the State having not less than seven years of continuous practice immediately preceding the last date fixed for receipt of online applications are also eligible for appointment.

AGE LIMIT: Must not have attained the age of Forty-Eight years in the case of candidates belonging to Scheduled Castes or Scheduled Tribes and Forty-Five years in the case of others, as on the last date fixed for receipt of online applications.

Note: The maximum age limit is relaxed by three years in case of Ex-servicemen candidates. SCALE OF PAY: Rs.51550-1230-58930-1380-63070. PROBATION: A candidate selected will be initially on probation for TWO years or for extended period, if necessary and he/she must undergo such training as may be specified by the High Court.

COMPETITIVE EXAMINATION:

I. The Competitive Examination for recruitment of District Judges shall consist of 3 stages namely

(a) Preliminary Examination

(b) Main Examination and

(c) Vivavoce:-

 (a) PRELIMINARY EXAMINATION: The Preliminary Examination shall be conducted by way of Objective Type Question Paper with multiple choices of 1½ hours (Ninety minutes) duration consisting of 100 marks. The syllabi for the said examination shall be the following, namely:-

  • Part-A - Civil Law.
  • Part-B - Criminal Law.
  • Part-C - General Knowledge (Test of reasoning and Mental aptitude)

(b) MAIN EXAMINATION:

The Competitive Written Examination for recruitment of District Judges shall consist of:

(i) Written examination of two papers each of three hours duration with 150 maximum marks for each paper - one in Civil Law and another in Criminal Law.

(ii) It is compulsory for all candidates to answer at least one of the paper in English language and in so far as the other paper is concerned, it shall be optional for the candidates to answer the same either in English or in Kannada in which event the said paper shall be answered entirely in the language in which option is exercised.

(c) VIVA-VOCE:

  • (i) The viva-voce shall carry maximum 50 marks.
  • (ii) The candidate’s General knowledge, grasp on principles of law and suitability for appointment as District Judge shall be tested.

(1) Minimum marks for pass in the Preliminary Examination shall be 50 for candidates belonging to Scheduled Castes and Scheduled Tribes and 60 for others.

(2) The minimum marks for pass in each paper of the written examination carrying 150 marks, shall be 50 marks in each paper for candidates belonging to Scheduled Caste/Scheduled Tribe and 60 marks for others. However, total marks to be secured for pass in the written examination shall be 120 marks out of 300 for Scheduled Caste/Scheduled Tribe and 150 marks out of 300 for others. In order to be considered under General Category, a candidate belonging to Scheduled Caste/Scheduled Tribe has to secure the minimum marks prescribed for General category in the Preliminary Examination, Main Written Examination and Viva-voce.

(3) From among the candidates who are eligible for Viva-voce as per clause (2), as far as may be, such number of candidates as is equal to three times the number of vacancies notified, having regard to the number of vacancies in each reserved category, selected in the order of merit, shall be called for Vivavoce.

(4) Candidate belonging to a Scheduled Caste or a Scheduled Tribe who obtains minimum of forty percent and a candidate not belonging to a Scheduled Caste or Scheduled Tribe, who obtains a minimum marks of fifty percent in the viva-voce shall be eligible to be considered for selection to the posts.

(5) Selection of candidates shall be made in the order of merit on the basis of aggregate of the marks obtained in the Written Examination and Viva-voce test, subject to the Government Orders relating to reservation of posts for Scheduled Castes, Scheduled Tribes and other backward classes. 

Provided that no candidate who has secured less than the minimum marks specified above:

  • (i) in any paper of the Written Examination shall be eligible for Viva-Voce.
  • (ii) in any paper of the Written Examination or in viva-voce shall be eligible for appointment as District Judge.

DISQUALIFICATION FOR APPOINTMENT:

No person shall be eligible for appointment to the service –

(a) Unless he/she is a citizen of India;

(b) if he/she is compulsorily retired, removed or dismissed from judicial service or from service in Government or Statutory or Local Authority or if a candidate after being selected as a Judicial Officer has been discharged from service during probationary period.

(c) if he/she has been convicted of an offence involving moral turpitude or who is or has been permanently debarred or disqualified by the High Court or the Union Public Service Commission or any State Public Service Commission from appearing for examinations or selections conducted by it or has been removed from its roll by any Bar Council;

(d) if any penalty or punishment has been imposed by the Bar Council or any Disciplinary Authority which in the opinion of Selecting Authority, makes the applicant unsuitable for a judicial post;

(e) if he/she directly or indirectly influences the Recruiting Authority by any means for his/her candidature;

(f) if the marital status of the candidate is bigamous.

MODE OF PAYMENT OF FEE:

(i) ONLINE PAYMENT: On submission of application through online, the candidate shall make online payment of prescribed fee by State Bank of India (SBI) online payment gateway through the link http://karnatakajudiciary.kar.nic.in/recruitment.asp OR

(ii) CHALLAN PAYMENT: On submission of application through online, the candidate shall download the challan in PDF format from the SBI online payment gateway through the link http://karnatakajudiciary.kar.nic.in/recruitment.asp and shall remit the prescribed fee in any branch of SBI (System needs to support PDF reader like Adobe, Acrobat).

Last date for submission of online application 21.10.2020 (Till 11.59 P.M.)

Last date for payment of fee through online 28.10.2020 (Till 11.59 P.M.)

Last date for payment of fee through Challan 28.10.2020 (Till Banks working hours)

1) Preliminary Examination Fee: The Candidate shall remit an amount of Rs.500/- (Rupees Five Hundred only). But, in the case of candidate belonging to SC/ST/Category-I, the fee payable shall be Rs.250/- (Rupees Two Hundred and Fifty only).

2) Main Examination Fee shall be payable by each candidate who is successful in the Preliminary Examination and eligible to appear for the Main Examination immediately within 15 (Fifteen) days from the date of announcing the result of the Preliminary Examination, failing which, their candidature will not be considered for Main Examination. The candidate shall remit an amount of Rs.1,000/- (Rupees One Thousand only). But, in the case of candidate belonging to SC/ST/Category-I, the fee payable shall be Rs.750/- (Rupees Seven Hundred and Fifty only).

3) Fee once paid shall not be refunded under any circumstances.

4) Candidates shall appear for the Preliminary Examination, Main Examination and Viva-Voce at their own cost.

5) Candidates are required to submit their application through Online Mode only and applications submitted by any other mode will not be entertained.

6) The candidates shall possess the following certificates/documents as on the last date fixed for receipt of online applications:

  • (i) Certificate of Enrolment as Advocate/Pleader, issued by the Bar Council.
  • (ii) List of cases conducted independently during the last three years with particulars of such cases.
  • (iii) Certificate issued by the Presiding Officer of the Court in which the candidate is actually practicing or Certificate issued by the Registrar (Judicial)/Additional Registrar General, if he/she is practicing in the High Court, indicating that he/she is a practicing Advocate. The certificate shall also indicate that he/she has been practicing as an Advocate for a period not less than seven years as on the last date fixed for receipt of online applications.
  • (iv) Two character certificates of good character (one from the Principal of the Institution/College in which the candidate has last studied with study details and another from a respectable person not being a relative who is well acquainted with the candidate).
  • (v) Income Tax return, if any, to show the annual income from the profession during the preceding three years.

7) The Public Prosecutor/Assistant Public Prosecutor–cum-Assistant Government Pleader shall submit his/her application through online not later than the date and time fixed for receipt of online applications and shall possess “No Objection Certificate” issued by the Competent Authority for having permitted him/her to apply for the post of District Judge, as on the last date fixed for receipt of online applications and produce the same as and when directed by the Selection Committee.

8) Candidates claiming reservation under SC/ST and Category-I/II(A)/II(B)/ III(A)/III(B) shall possess the caste certificate in the format as prescribed by the Government of Karnataka and issued by the Competent Authority, as on the last date fixed for receipt of online applications and produce the same as and when directed by the Selection Committee.

9) Candidates claiming reservation under Ex-servicemen category shall possess the certificate of release or discharge from military service, as on the last date fixed for receipt of online applications and produce the same as and when directed by the Selection Committee.

10) Candidates claiming reservation under Rural category should have studied from 1st standard to 10th standard in rural areas. The candidate shall possess the Rural Study Certificate in the format as prescribed by the Government of Karnataka in its G.O. No.DPAR 96 SRR 2005 dated 10.08.2005, issued by the Head Master of the School and countersigned by the concerned Block Educational Officer (BEO), as on the last date fixed for receipt of online applications and produce the same as and when directed by the Selection Committee. General Merit candidates claiming reservation under Rural category shall also possess relevant certificate in the format as prescribed by the Government of Karnataka in its G.O. No.DPAR 08 SRR 2001 dated 13.02.2001, issued by the concerned Tahsildar certifying that they do not fall under the creamy layer, as on the last date fixed for receipt of online applications.

11) Candidates claiming reservation under Kannada Medium Student category shall possess certificate for having studied in Kannada Medium from 1st standard to 10th standard in the prescribed format as per Government Notification No.DPAR 71 SRR 2001 dated 24.10.2002, issued by the Head Master of the School, as on the last date fixed for receipt of online applications and produce the same as and when directed by the Selection Committee.

12) Candidates called for document verification at the time of viva-voce shall furnish all the relevant original certificates along with three sets of selfattested copies i.e., SSLC or any equivalent certificate in support of their Date of Birth, Marks Cards and Convocation Certificates of Degree and Law Degree, Caste Certificate, Certificates for having claimed reservation under Rural/Kannada Medium/Ex–servicemen category, etc., for verification.
