I have filed a civil suit regarding cancellation of sale deed. I have sold the property in the year 2013. That means sale deed and agreement was done in the year 2013. That person who purchased the land, cheated me, he has promised to give apartment instead of money and he did not construct any apartment in that place.He was expired in 2017.His son has written another agreement on 100 rupees stamp paper in the year 2018 regarding the payment of money, which his father failed to give me.I have filed the suit regarding cancellation of sale deed. Now I heard from that I can cancel the sale deed only 3 years from the date of sale of property. Mean while as my civil suit is pending in the court, the opposite party has sold the property to some other person.
Now I am worried whether I should continue the same civil suit (the agreement validity is only three years ) or I should file a seperate money recovery case in the court. Kindly answer.
